Risk Disclosure Statement

Last Updated: February 12, 2026

⚠️ Important Notice

Please read this risk disclosure statement carefully before participating in any DayTrader Funding evaluation or funded trading program. Trading futures involves substantial risk of loss and is not suitable for all individuals. You should carefully consider whether trading is appropriate for you in light of your financial situation and risk tolerance.

1. Futures Trading Risk

Trading futures and options involves substantial risk of loss and is not suitable for all investors. The amount you may lose may be greater than your initial investment. Before trading futures, you should carefully consider:

  • Your financial condition and whether you can afford to lose money
  • Your risk tolerance and investment objectives
  • Your level of trading experience and knowledge
  • Whether futures trading is appropriate for your situation

You should be aware that you could sustain a total loss of the margin funds you deposit with a broker to establish or maintain a position in the futures market. If the market moves against your position, you may be called upon to deposit additional funds on short notice to maintain your position. If you do not provide the required funds, your position may be liquidated at a loss, and you will be liable for any resulting deficit.

Only trade with money you can afford to lose. Do not use rent money, savings needed for essential expenses, or borrowed funds to purchase evaluation accounts or trade futures.

2. Past Performance Disclaimer

Past performance is not indicative of future results. The fact that a trader performed well in an evaluation or in past trading does not mean they will perform similarly in the future. Market conditions change constantly, and historical returns—whether in simulated or live trading—should not be relied upon as a predictor of future profitability.

Performance results shown on our website, marketing materials, or user testimonials are not assurances of what you will achieve. Individual results will vary based on market conditions, trading skill, risk management, discipline, and other factors.

Statistics about payout amounts, pass rates, or trader earnings are historical data and do not predict your personal results.

3. Simulated vs. Live Trading

There are significant differences between simulated trading and live trading with real money.

3.1 Day Trader Funding Uses Simulated Trading

Day Trader Funding evaluation accounts and funded accounts operate in a simulated trading environment using real-time market data. This means:

  • You are not placing real trades in live markets
  • No real capital is at risk in your trading account
  • Profits and losses are calculated in simulated, not real, dollars
  • When you receive a payout, we convert simulated profits to real cash compensation

3.2 Simulated Trading Limitations

While our simulated environment uses real-time market data, simulated trading:

  • Does not involve real financial risk — simulated losses do not affect your actual finances, which may lead to different decision-making compared to trading real money
  • May have different execution — simulated fills may differ from what you would experience in live markets, particularly during high-volatility periods or with large position sizes
  • Lacks market impact — in simulation, your orders do not affect market prices, whereas in live trading with significant size, your orders can move the market
  • May not reflect liquidity constraints — simulated environments may fill orders that would experience slippage or partial fills in real markets

3.3 Psychological Differences

Trading with simulated money is psychologically different from trading with real money. Traders often behave differently when their actual finances are at stake. The absence of real financial consequences in simulated trading may lead to overconfidence or risk-taking that would not be replicated in live trading.

4. Our Prop Firm Model

4.1 What We Are

Day Trader Funding operates a proprietary trading evaluation business. We provide:

  • Evaluation programs — simulated trading assessments to identify skilled traders
  • Funded accounts — successful traders receive accounts funded with simulated capital using real market data
  • Performance-based compensation — traders receive a share of simulated profits as cash payments (payouts)

4.2 What We Are NOT

Day Trader Funding is not:

  • A broker-dealer — we do not execute securities transactions or hold customer trading funds
  • A Futures Commission Merchant (FCM) — we do not accept customer funds for trading futures
  • A Commodity Trading Advisor (CTA) — we do not provide trading advice or manage customer accounts
  • An introducing broker — we do not solicit customer accounts for FCMs
  • An investment advisor — we do not provide personalized investment advice
  • A hedge fund or investment fund — we do not pool customer capital

We are a technology and evaluation services company. The trading accounts we provide are simulated, and compensation paid to traders is based on performance in these simulated environments.

5. Not Investment Advice

Nothing on this website or in our communications constitutes financial, investment, tax, or legal advice. All content is for educational and informational purposes only.

  • We do not recommend specific trades, strategies, or investments
  • We do not provide personalized advice based on your financial situation
  • Educational content about trading is not a recommendation to trade
  • You should consult with a qualified financial professional before making any trading decisions

Our Coached tier provides general trading education and live trading demonstrations. This is not personalized investment advice — all trading decisions remain your own responsibility.

6. Your Trading Decisions

You are solely responsible for your own trading decisions. Day Trader Funding does not make trading decisions on your behalf. You decide:

  • What instruments to trade
  • When to enter and exit positions
  • Position sizing and risk management
  • Whether to use stops, limits, or other order types

Any losses or gains resulting from your trading are your responsibility. The AI Risk Manager tool, if used, is an optional assistant that you choose to enable; it does not relieve you of responsibility for your trading outcomes.

7. No Assurance of Profits or Income

Day Trader Funding makes no assurances of profitability or income.

  • The majority of traders do not achieve consistent profitability
  • Most evaluation attempts do not result in a funded account
  • Passing an evaluation does not mean you will be profitable in a funded account
  • Payouts are not assured and are subject to trading performance and rule compliance
  • Individual results will vary based on skill, discipline, market conditions, and other factors

Do not participate in Day Trader Funding programs expecting to generate income or profits. Trading is risky, and most traders lose money.

8. Tax Responsibility

You are solely responsible for any tax obligations arising from your participation in Day Trader Funding programs.

  • Performance-based compensation (payouts) may be taxable income in your jurisdiction
  • We do not provide tax advice and cannot advise you on your tax obligations
  • You should consult with a qualified tax professional regarding your specific situation
  • If required by law, we may issue tax reporting documents (e.g., 1099 forms for U.S. residents)

It is your responsibility to understand and comply with all applicable tax laws in your jurisdiction.

9. Third-Party Services

Day Trader Funding relies on third-party platforms for trade execution, market data, and payment processing. We are not responsible for:

  • The performance, reliability, or availability of third-party services
  • Data feed delays, errors, or interruptions
  • Platform downtime or technical failures
  • Actions taken by third-party providers

Any disruptions to third-party services are beyond our control and may affect your trading experience or results. We use Your Prop Firm (YPF) for our trading infrastructure and real-time market data.

10. Account Rules

All traders must comply with the account rules outlined on our Rules page.

  • Violation of any rule may result in immediate account termination without refund
  • Rules are designed to enforce risk management and protect the integrity of the program
  • Rules are subject to change — however, we commit that changes will only be more generous to traders
  • It is your responsibility to stay informed of current rules

11. Funded Account Termination

Day Trader Funding reserves the right to modify, suspend, or terminate any funded account at its discretion for:

  • Violation of account rules or Terms of Service
  • Suspected fraudulent or manipulative trading activity
  • Failure to complete identity verification
  • Operating from a restricted jurisdiction
  • Any other reason specified in our Terms of Service

12. Trade Replicability

Because funded accounts use simulated trading, there may be instances where trades executed in simulation could not be replicated in live markets due to:

  • Liquidity constraints at the time of execution
  • Execution timing differences between simulation and live markets
  • Price levels that were only available briefly

DTF reserves the right to review trades and adjust payout amounts if trades could not reasonably be replicated in live market conditions.

13. Acknowledgment

By purchasing an evaluation account, creating an account on our platform, or participating in any Day Trader Funding program, you acknowledge that:

  • You have read and understood this risk disclosure statement
  • You understand that futures trading involves substantial risk of loss
  • You accept full responsibility for your trading decisions
  • You understand the differences between simulated and live trading
  • You are not relying on Day Trader Funding for investment advice
  • You understand that past performance is not indicative of future results
  • You are responsible for your own tax obligations
  • You are only using money you can afford to lose to purchase evaluation accounts
